Schools
*Thornbrook subdivision is part of the Cobb County School district. Schools that the subdivision are districted to are: Nicholson Elementary School, McCleskey Middle School and Sprayberry High School.
Common Areas
*All community members are welcome to use the common areas. Yearly HOA fees need to be paid to access the pool and tennis courts.
*No dumping of yard debris in our common area, particularly the area around the lake and the nature trail. *Fishing is prohibited due to fishing line getting caught in and breaking the fountains.
Parking in the pool parking lot
* All parking for longer than 48 hours in the pool/tennis parking area is subject to the approval of the Thornbrook Board of Directors. Unauthorized vehicles will be towed.
*Warnings are issued on unauthorized vehicles prior to be towed.
*If you get towed, call Ingram Towing at 770-517-7470
*PLEASE NOTE THAT THE COMMON AREA PROPERTY (INCLUDING THE PARKING LOT) IS UNDER VIDEO SURVEILLANCE FOR SAFETY AND SECURITY PURPOSES*
Pets
*All pets shall be on a leash per Cobb County Leash Law – Violations should be reported to Cobb
County Animal Control (770-499-4136). Even the most well-behaved pets can act unpredictably.
*Please clean up after your pet (i.e., a pooper scooper, baggies, etc.) in the common areas and your neighbors yards. Doggy waste stations are located at the parking lot and the start of the nature trail off of Lazy Creek Drive.
*It is in violation of Cobb County Codes to let dogs urinate or defecate on lawns, ornamental plants and flowers.
*If you do not pick up your dog waste in the common areas, you may be reported and fined by Cobb County for a code violation.
Garage/Yard Sales of any type:
*Individual yard or garage sales are prohibited (see Covenants) except on two dates set each year by the Board of Directors.
Parking On Our Streets
*Do not park your car across from another on the street. Blocking access to the street prevents emergency vehicles and other cars from safely using the road.
*Cars are not to be parked on the street in the subdivision “as a matter of course” and should be parked in driveways or garages. All commercial vehicles including those with advertising decals and logos must be parked either off site or inside your garage.
*Please report hazardous road situations in our subdivision by calling (770) 499-3987 or (770) 499-3911.
Annual HOA Dues
*Representatives are elected to serve your interests for the coming year. Board members are elected by you – the resident - as volunteers who put in time and effort to do the duties of HOA requirements.
*The annual dues invoice and trash bill are sent at the beginning of the new year. Please pay the annual dues and trash invoice by March 1st and make payable to Thornbrook HOA, Inc., 3595 Canton Road, Suite 116-238, Marietta, GA 30066
Note: No homeowner is exempt from paying the annual HOA dues even for “non-use” of any amenity or service provided by the Association as part of the annual budget, as Article 4, Section 4.5 on the Thornbrook Covenants provides that “each Owner of a Residence, by acceptance of a deed for a Residence” covenants and agrees to pay the annual assessment. It does not state that each Owner of a Residence who only uses some of the Association’s services is authorized to pay only a portion of the annual assessment. But rather, Article 4, Section 4.7 of the Declaration expressly provides that the annual assessment must be fixed at a uniform rate for ALL Residences.
*Pursuant to Paragraph 4 of the Declaration of Covenants, Restrictions and Easements for Thornbrook Subdivision (“Declaration”), as amended, each Owner of a Residence, by acceptance of a deed for a Residence in the Thornbrook community, agrees to pay the Association annual dues and special assessments as authorized by Article 4, Sections 4.4 and 4.5 of the Declaration to be charged by the Thornbrook Homeowners Association, Inc. (“Association”) for the purpose of “providing for the common good and general welfare of the people of the community”. Per Article 4, Section 4.2 of the Declaration, the assessments levied by the Association may be used for such items as: security, acquisition, construction, improvement, maintenance and equipping of the Common Property. Section 4.2 also expressly states that the assessments are not limited to just this list of services to be provided by said assessments. Additionally, Article 4, Section 4.6 of the Declaration provides that the Board shall establish the annual dues for each assessed year, and the Board shall also establish the annual budget which shall list the estimated operating expenses and shall contain an amount to be set aside each year into a reserve allowance to be used for future repair and replacement of the Common Property.
*Since the Board of Directors is authorized to both determine the common expenses that will go into the annual budget, and to set the annual dues therefore, the Board is authorized to include a line item for trash removal service if the Board deems it to be in the best interests of the community to provide such a service, and so long as said service is offered to all homeowners the costs of said service may be included in the annual assessment.
